Abstract

This talk deals with Nietzsche's philosophy in general, and criminal law in particular. Indeed it so happens that, in the period when Nietzsche (1844-1900) writes the two volumes of Human, All Too Human (1876-1879), he destroys the foundations of criminal law after exposing them one by one. Does the destruction give way to reconstruction? Or at least does it allow him to consider the possibility of a new criminal law?

Keywords: Versuch, justice, criminal law, punishment, freedom, responsibility.
